{"id":6789,"date":"2025-07-03T03:44:38","date_gmt":"2025-07-03T03:44:38","guid":{"rendered":"https:\/\/panoramanews.com.ng\/?p=6789"},"modified":"2025-07-03T03:45:55","modified_gmt":"2025-07-03T03:45:55","slug":"mohbad-court-thrashes-fathers-fathers-suit-against-naira-marley-sam-larry","status":"publish","type":"post","link":"https:\/\/panoramanews.com.ng\/index.php\/2025\/07\/03\/mohbad-court-thrashes-fathers-fathers-suit-against-naira-marley-sam-larry\/","title":{"rendered":"Mohbad: Court thrashes father\u2019s suit against Naira Marley, Sam Larry"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-6790\" src=\"https:\/\/panoramanews.com.ng\/wp-content\/uploads\/2025\/07\/download.jpg\" alt=\"\" width=\"299\" height=\"168\" \/><\/p>\n<p>Mohbad and father<\/p>\n<p>By Publisher<\/p>\n<p>Kindly share:<\/p>\n<div dir=\"auto\">Joseph Aloba, father of the late musician Ilerioluwa Aloba, also known as Mohbad, has lost in his bid to invalidate the legal advice of the Directorate of Public Prosecutions, which absolved music label owner, Naira Marley, Sam Larry, and others of alleged complicity in his son\u2019s death.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Apart from the duo, other suspects included Prime Boy, and Babatunde Opere.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\n<p>In a Wednesday ruling,\u00a0Justice Taiwo Olatokun of the Lagos State High Court in Ikeja has dismissed the suit and\u00a0held that it was the constitutional right of the Attorney General of Lagos State, acting through the DPP, to determine whether or not to prosecute any suspect and cannot be judicially reviewed, as\u00a0sought by Aloba, who was represented by Wahab Shittu.<\/p>\n<p>\u201cThe powers of the Attorney General as conferred by the Constitution are not subject to judicial review in this context,&#8221; Olaokun said.<\/p>\n<p>\u201cAccordingly, the reliefs sought by the applicant lack merit and are hereby dismissed.\u201d<\/p>\n<p>Aloba had alleged a breach of fair hearing, contending that\u00a0the DPP\u2019s legal advice, undermined the integrity of the ongoing coroner\u2019s inquest into the death of the singer.<\/p>\n<\/div>\n<div dir=\"auto\">\n<p>However, the court disagreed, saying the DPP\u2019s decision was lawful and based on the available evidence.The judge explained that the suspects\u00a0 were not acquitted, as they were discharged due to insufficient evidence linking them to Mohbad\u2019s death.<\/p>\n<p>According to the legal advice, according to Ayinde Ibrahim, a legal officer from the DPP\u2019s office, in a counter-affidavit filed on June 24, 2025,\u00a0that the legal advice resulted from a thorough review of the police case file, adding that\u00a0neither the coroner nor the applicant had access to the full findings upon which the advice was based.<\/p>\n<p>\u201cThe legal advice did not find any direct or circumstantial evidence tying the named suspects to the death of the deceased,\u201d Ibrahim disclosed.<\/p>\n<p>\u201cTherefore, the advice to discharge them was in line with due process and the available evidence.\u201d<\/p>\n<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Mohbad, the upcoming singer died suddenly and mysteriously on September 27, 2023.
