{"id":6676,"date":"2025-06-27T11:50:30","date_gmt":"2025-06-27T11:50:30","guid":{"rendered":"https:\/\/panoramanews.com.ng\/?p=6676"},"modified":"2025-06-27T20:34:46","modified_gmt":"2025-06-27T20:34:46","slug":"controversy-over-demolition-of-peter-obis-brothers-property-in-lagos-continued-counsel-faults-ownership-claim-says-lagos-gave-consent-in-2013-lagos-denies-involvement","status":"publish","type":"post","link":"https:\/\/panoramanews.com.ng\/index.php\/2025\/06\/27\/controversy-over-demolition-of-peter-obis-brothers-property-in-lagos-continued-counsel-faults-ownership-claim-says-lagos-gave-consent-in-2013-lagos-denies-involvement\/","title":{"rendered":"Controversy over demolition of Peter Obi&#8217;s brother&#8217;s property in Lagos continues, counsel faults ownership claim, says Lagos gave consent in 2013&#8230;Lagos denies involvement"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-6677\" src=\"https:\/\/panoramanews.com.ng\/wp-content\/uploads\/2025\/06\/Z-2.jpg\" alt=\"\" width=\"192\" height=\"108\" \/><\/p>\n<p>Obi at the demolished property<\/p>\n<p>By Publisher<\/p>\n<p>Kindly share:<\/p>\n<div dir=\"auto\">The last is yet to be heard on the demolition of\u00a0Next Foods Limited, a company in which Ndibe Obi, younger brother of the 2023 Labour Party Presidential Candidate, Mr Peter Obi, holds a majority stake.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\n<p>The property was demolished on Tuesday in Ikeja, Lagos, following claims of ownership by Deborah Olorunlogbon, and a purported legal approval for recovery of the property, resulting in the demolition.<\/p>\n<p>Chief Emeka Okpoko, SAN, the lead Consel to Next foods limited,\u00a0 spoke with newsmen in Awka on Thursday,<\/p>\n<\/div>\n<div dir=\"auto\">describing the ownership claim by one Olorunlogbon as inconsistent and fraught with legal defects.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\n<p>Okpoko stated that the matter would be challenged in court.<\/p>\n<p>He explained that the property was duly acquired by Next Foods Limited in 2011 and that the Governor of Lagos State granted consent to the transaction in 2013.<\/p>\n<p>\u201cThe property was purchased in 2011. A deed of assignment was executed and duly registered, tracing the title history from the era of Western Nigeria\u2014when the land registry was based in Ibadan\u2014down to the most recent transaction. The legal chain is clearly documented,\u201d he said.<\/p>\n<p>On the recent demolition, the senior lawyer recounted: \u201cLast week, I was alerted that persons came claiming to levy execution. I reviewed the court documents presented and found that the case was filed by Deborah Oluwalogbon against \u2018persons unknown.\u201d<\/p>\n<p>According to him, the originating summons in question was not a suit over ownership but for possession. He raised concerns about the legality of the process, particularly the mode of service.<\/p>\n<p>\u201cYou cannot serve a registered company via substituted service. What appears to have happened is that they pasted the notice in an inconspicuous part of the property, photographed it, and likely removed it thereafter. We never received any notification during the pendency of the case,\u201d he added.<\/p>\n<p>Okpoko further expressed suspicion over the timeline of events. \u201cJudgment was obtained in 2024, yet execution was delayed until 2025\u2014well outside the six-month execution window. To compound matters, a Certificate of Occupancy (C of O) was allegedly obtained in 2025\u2014after the judgment.\u201d<\/p>\n<p>He questioned the validity of the said C of O, stating: \u201cThey relied on a Federal C of O issued in 2021 by the Federal Ministry of Works, Ikoyi. Yet, we had already secured the Governor\u2019s consent on the same property in 2013. No subsequent document can override a validly rooted title.\u201d<\/p>\n<p>The senior advocate noted that the issuance of a C of O cannot rectify a fundamentally defective title. \u201cIf the root of title is tainted by illegality or irregularity, no C of O can cure it. The law is clear on that.\u201d<\/p>\n<p>Okpoko confirmed that Next Foods Limited had filed applications in court to be joined as a party, amend the suit to reflect its interest, set aside the earlier judgment, and halt any further execution pending the hearing of the substantive matter.<\/p>\n<p>\u201cWe are confident in our legal position. Once the court hears our side, we believe justice will prevail,\u201d he concluded.<\/p>\n<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">\n<p>Meanwhile, the Lagos State Government has distanced itself from\u00a0the demolition exercise.<\/p>\n<p>Following Obi&#8217;s description of the demolition as epitomising worsening lawlessness and disregard for human rights in Nigeria, Gbenga Omotoso, the Lagos State commissioner for information and strategy issued a statement, saying: &#8220;We wish to categorically state that the Lagos State Building Control Agency (LASBCA) or any other arm of the Lagos State Government did not carry out the said demolition.&#8221;<\/p>\n<div dir=\"auto\">The commissioner further said: &#8220;We find it disturbing that Mr Peter Obi would make such allegations without verifying the facts,\u201d adding\u00a0that the government remains committed to the rule of law and public safety.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">However, he\u00a0directed the Permanent Secretary in the Office of Urban Development, Gbolahan Oki, to initiate a full investigation through LASBCA to ascertain what exactly happened.<\/div>\n<div
