{"id":4093,"date":"2025-01-08T09:58:37","date_gmt":"2025-01-08T09:58:37","guid":{"rendered":"https:\/\/panoramanews.com.ng\/?p=4093"},"modified":"2025-01-08T09:58:37","modified_gmt":"2025-01-08T09:58:37","slug":"why-i-wont-continue-with-my-trial-by-govt-nnamdi-kanu","status":"publish","type":"post","link":"https:\/\/panoramanews.com.ng\/index.php\/2025\/01\/08\/why-i-wont-continue-with-my-trial-by-govt-nnamdi-kanu\/","title":{"rendered":"Why I won&#8217;t continue with my trial by govt &#8211; Nnamdi Kanu"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-4094\" src=\"https:\/\/panoramanews.com.ng\/wp-content\/uploads\/2025\/01\/download-4-2-300x300.jpeg\" alt=\"\" width=\"300\" height=\"300\" srcset=\"https:\/\/panoramanews.com.ng\/wp-content\/uploads\/2025\/01\/download-4-2-300x300.jpeg 300w, https:\/\/panoramanews.com.ng\/wp-content\/uploads\/2025\/01\/download-4-2-150x150.jpeg 150w, https:\/\/panoramanews.com.ng\/wp-content\/uploads\/2025\/01\/download-4-2.jpeg 332w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>Ejimakor, Kanu<\/p>\n<div dir=\"auto\">\n<div dir=\"auto\">By Publisher<\/div>\n<div dir=\"auto\">Kindly share:<\/p>\n<p>Mazi Nnamdi Kanu, the\u00a0leader of the Indigenous People of Biafra, IPOB,\u00a0shunned government\u2019s request to continue his trial.<\/p>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">This was contained\u00a0 in a letter addressed to the court in December, which his special counsel,\u00a0posted on his X handle on Tuesday.<\/p>\n<p>The IPOB leader&#8217;s, who has been in detention since his controversial repatriation to Nigeria from Kenya in June 2021, is being tried for alleged\u00a0for alleged terrorism by the Nigerian government.<\/p><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The trial has witnessed reversals, including Kanu&#8217;s demand that the trial Judge,\u00a0Justice Binta Nyako to recuse herself from his trial because of alleged bias.<\/p>\n<p>The judge subsequently announced her withdrawal from the matter, but the Chief Judge of the Federal High Court later still reassigned the matter to her.<\/p>\n<p>Consequently, the prosecuting counsel, Adegboyega Awomolo, SAN, requested the court to fix a date to continue the Kanu\u2019s trial in\u00a0 a letter dated December 5, 2024.<\/p>\n<p>\u201cWe write as prosecuting counsel in the above-named criminal case pending before the Federal High Court,\u201d Mr Awomolo wrote.<\/p>\n<p>\u201cYour record will reveal that the defendant asked His Lordship, the Honourable Justice Binta Nyako, to recuse herself on Tuesday, 24th September 2024. The case file was returned to the Honourable Chief Judge.<\/p>\n<p>\u201cWe were informed that the Honourable Chief Judge had returned the case file for the continuation of trial before His Lordship, the Honourable Justice Binta Nyako.<\/p>\n<p>\u201cGrateful, may we ask for a date for the continuation of the hearing of the criminal charges against the defendant.\u201d<\/p>\n<p>However, Kanu rejected the government\u2019s request through Ejimakor,\u00a0 insisting that Mrs Nyako\u2019s order recusing herself from the case remains valid.<\/p>\n<p>Ejimakor in a letter addressed to the court\u2019s Deputy Chief Registrar on behalf of Mr Kanu, stated that the IPOB leader was displeased with the letter by the Nigerian government.<\/p>\n<p>\u201cOur position is predicated on the fact that His Lordship, Hon. Justice Binta Murtala-Nyako, had entered and enrolled an order recusing herself from handling the case,&#8221; he wrote.<\/p>\n<p>\u201cThe said order entered on 24th September 2024 remains extant and subsisting, as it has not been set aside by any competent court order.<\/p>\n<p>\u201cFor the avoidance of doubt, as of 24th September 2024, the defendant no longer has any such case to answer before Hon.
