A fresh controversy has erupted over a United States court ruling, involving President Bola Tinubu, with a US-based political advisory and lobbying firm, Von Batten-Montague-York, accusing the Nigerian Presidency of selectively presenting the judgment to conceal developments unfavourable to the President.<\/p>\n

The dispute followed an October 30, 2026 ruling by the US District Court for the District of Columbia in a Freedom of Information Act (FOIA) lawsuit instituted by Aaron Greenspan, seeking access to investigative records held by the Federal Bureau of Investigation (FBI) and the Drug Enforcement Administration (DEA), concerning allegations of drug trafficking involving Tinubu.<\/p>\n

The controversy was triggered after the Presidency publicised the court’s rejection of Greenspan’s attempt to obtain discovery from Tinubu and political consulting firm DCI Group over alleged cyberattacks against his website.<\/p>\n

The court held that the proposed discovery was insufficiently relevant to the central issues in the FOIA proceedings, which concern access to federal investigative records. It also rejected Greenspan’s motion for summary judgment and dismissed an application by nonparty Karl Von Batten to file an amicus curiae brief.<\/p>\n

However, Von Batten-Montague-York, in a statement published on its X account, accused the Presidency of deliberately highlighting the discovery setback while omitting what it described as critical aspects of the judgment, concerning the FBI and DEA.<\/p>\n

Describing the Presidency’s account as a “lie by omission”, the firm argued that the rejected discovery application related to a separate dispute over alleged cyberattacks and had no bearing on the substantive FOIA litigation.<\/p>\n

More significantly, it claimed that the court had rejected several justifications advanced by the federal agencies for withholding investigative records relating to Tinubu and his alleged associate, Abiodun Agbele.<\/p>\n

Among the issues highlighted was the court’s criticism of the agencies’ reliance on what it described as vague, boilerplate and imprecise explanations for withholding portions of the records.<\/p>\n

The firm particularly drew attention to the court’s rejection of the DEA’s generic explanations for withholding information relating to wiretaps and pen registers, arguing that the agency had failed to discharge its legal burden of justifying the secrecy.<\/p>\n

Another significant issue concerned a 1993 affidavit by IRS Special Agent Kevin Moss, filed in an asset-forfeiture proceeding connected to an investigation into alleged heroin distribution and money laundering.<\/p>\n

The document, which is already part of the public court record, reportedly contains details of the historical investigation and financial transactions associated with Tinubu and Agbele.<\/p>\n

According to the firm, the court reasoned that information already publicly available could not simply be withheld again through broad claims of privacy or secrecy. It argued that the agencies must properly account for information already in the public domain when reviewing the requested records.<\/p>\n

The court consequently directed the FBI and DEA to undertake further reviews and provide more detailed justifications for information they still intend to withhold, with November 27, 2026 set as the deadline.<\/p>\n

The ruling, however, does not amount to an order for the wholesale release of the investigative files. Nor does it establish that Tinubu committed drug trafficking or any other criminal offence. Rather, it addresses the adequacy of the federal agencies’ legal justifications for withholding government records under FOIA.<\/p>\n

This distinction is central to understanding the controversy.<\/p>\n

While the Presidency has drawn attention to the rejection of Greenspan’s attempt to obtain discovery from Tinubu, the lobbying firm insists that this procedural victory has been presented in a manner that obscures the unresolved questions, surrounding access to the historical investigative records.<\/p>\n

The actual judgment presents a mixed procedural outcome: the court rejected Greenspan’s own motion for summary judgment but also denied the federal agencies summary judgment on significant aspects of their withholding decisions.<\/p>\n

Consequently, neither the claim that the Presidency has secured a comprehensive legal victory nor the firm’s description of the ruling as a massive blow to Tinubu should be mistaken for the court’s actual findings.<\/p>\n

The underlying FOIA litigation remains unresolved, with the federal agencies required to revisit their explanations for withholding portions of the requested records.<\/p>\n

Ultimately, the issue is not whether Greenspan succeeded in obtaining permission to question Tinubu in an unrelated discovery application. He did not. The more substantive question is what further information the FBI and DEA will disclose, what they will continue to withhold, and whether their explanations will withstand judicial scrutiny.<\/p>\n
