A three-member panel of justices of the Court of Appeal in Abuja on Friday, upturned the order of the Code of Conduct Tribunal, CCT, which suspended the Chairman, Kano State Public Complaints and Anti-Corruption Commission, PCACC, Mr. Muhuyi Magaji.
In the lead judgment read by Justice Umaru Fadawu, the appeal court also ordered the re-assignmrnt of the matter to another panel of the CCT.
The panel agreed that the tribunal’s order was prejudicial and amounted to denying the suspect fair hearing, as argued by Mr Adeola Adedipe, SAN, Magaji’s counsel.
A three-member Code of Conduct
tribunal headed by Justice Danladi Umar, ordered the Magaji’s suspension, following allegations of misconduct preferred against him by the Code of Conduct Bureau, CCB.
Justice Umar, in his ruling, dismissed Magaji’s motion, and held that the tribunal competent and possessed the jurisdiction to hear the case, ordering the Kano State Governor Abba Yusuf and the Secretary to the State Government, SSG, to appoint the most appropriate officer as acting chairman of the commission, pending when the case would be determination.
He further held that Magaji cannot continue to discharge the duties and responsibilities of his office while facing trial, to avoid any interference with the case.
Magaji proceeded on appeal through his counsel, Mr Adedipe, approached the Court of Appeal, Abuja.
